Extension

Extension of status is applicable to individuals who wish to extend their stay in Canada beyond the authorized period specified on their current permit.

  • To apply for an extension of status, the applicant must submit an application before their current permit expires.

  • The application should include the required supporting documents, such as proof of financial support and a valid reason for the extension (e.g., continuing studies, ongoing employment, etc.).

  • While waiting for a decision on their extension application, the individual may remain in Canada under "implied status" until a decision is made, provided they applied before their current status expired.

  • If the extension application is approved, the individual's permit will be extended, allowing them to stay in Canada legally for the new authorized period.

Restoration

Restoration of status applies to individuals who have lost their temporary resident status (e.g., visitor status, work permit, study permit) because they failed to comply with the conditions of their permit or let it expire.

  • If a person's temporary status has expired, they typically have 90 days from the date of expiration to apply for restoration of status.

  • To restore their status, the applicant must submit a restoration application along with the required fees and demonstrate that they continue to meet the initial requirements for their permit (e.g., sufficient funds, valid study or work offer, etc.).

  • During the restoration period, the individual's status remains "implied status," which means they can continue to stay in Canada and may be eligible to work or study if they were authorized to do so before their status expired.

It's crucial to adhere to the application timelines and meet the specific requirements for restoration and extension of status. Late or improperly filed applications may result in loss of status, and individuals may be required to leave Canada if they are not eligible for restoration or extension.
